Сажетак: У Уводу рада, аутор излаже ставове у вези са значајем и улогом права као тековине од значаја за читав живот, привреду и односе у сваком друштву и држави. Излагањима настоји да пронађе везу између права и правде, кратко се позивајући на схватања Платона, Аристотела и Сократа. Аутор сматра да је задатак судије да у вршењу тешке, часне и одговорне функције, процес просуђивања заснива, пре свега, на законитом тумачењу прописа, у циљу отклањања спорова и успостављања стања мира у друштву и држави. Циљ рада је да, уз анализе изабраних случајева, који представљају примере лоше судске праксе у привредним стварима, укаже на неопходност појачане контролне функције, којима судска власт располаже, како у самом процесу суђења, тако и мерама ван тог процеса, искорени појаве злоупотребе поверења поклоњено суду, попут права на слободно судијско уверење судије.

Abstract: In the Introduction to the paper, the author presents views on the importance and role of law as an achievement of importance for life, economy and relations in every society and state. With his presentations, he tries to find the connection between law and justice, briefly referring to the understandings of Plato, Aristotle and Socrates. The author believes that the judge's task is to perform his difficult, honorable and responsible function, in the judgment process, based primarily on the legal interpretation of regulations, in order to resolve disputes and establish a state of peace in the country, including the economy. The aim of the paper is to, in accordance with the theme of the Conference of the Association of Lawyers in the Serbian Economy - "Companies and Commercial Judiciary", with the analysis of selected cases, which are examples of bad case law, indicate need to take measures to prevent and eliminate existing shortcomings in the activities jujdicial authorities in Serbia.
