Abstract: Serbian language is itself globalising, being critical part of the society, and as such, it is often an instigator of globalisation. The language of written law with its role in transforming the imaginary into real makes an excellent example. In this paper, from the perspective of critical discourse analysis, we consider syntactic-semantic strategies and their pragmatic effects in the current constitution of Serbia (2006) and its predecessor (1990) in comparison with the Convention on Human Rights (1950) and the Constitution for Europe (2004), as the representative normative instruments of europeanisation, which is a form of globalisation. We assume the hypothesis that the europeanisation of Serbia manifests itself in some patterns of structuring discourse units which are shared between the compared fundamental laws. Approving that hypothesis, in the comparative analysis we mostly focus on the parts which provide for human rights, because of the universality of that aspect of social relations, along with a brief view of the logical-pragmatic relationship of the new west(european) discourse to the present socio-legal discourse, represented by the SFRY Constitution of 1974, and to the social context, which is best reflected in the transitive Constitution of 1990. It is proved that the contemporary globalisation processes in the Serbian legal language, though more intriguing than before, haven’t begun with the new millenium, but have undoubtedly lasted for more than two decades, yet have by a great deal remained mystified in their linguistic aestheticisation

Sažetak: У овом истраживању, из перспективе критичке анализе дискурса, разматрамо синтаксичко-семантичке стратегије и њихове прагматичке ефекте у актуелном Уставу Србије и његовом претходнику у поређењу са Европском конвенцијом о људским правима и Уговором о Уставу за Европу, као репрезентативним нормативним инструментима глобализације. Показују се, одражавајући европеизацију, заједнички обрасци структурирања дискурсних јединица, махом посвећених људским правима, укључујући стратегије у погледу реченичне конструкције и неких лексичких решења, уз осврт на однос новог, (западно)европског дискурса према дотадашњем друштвеном дискурсу и контексту у поменутим домаћим уставима. Стога, савремени процеси глобализације путем српског правног језика, који их мистификује, остварују се сигурно више од две деценије.
