Abstract: The stringency of employment protection legislation has an important impact on labour market flows and is one of the key determinants of flexibility of this market. Empirical studies aimed at assessing the impact of employment protection legislation on labour market performance, primarily on employment and unemployment rates, do not give consistent results, which is partly a consequence of differences in other institutional characteristics of the countries observed, which are often omitted from the analysis and in some cases are difficult to measure. On the other hand, the EPL index, which serves as a numerical measure of the strictness of employment protection legislation, has certain disadvantages. In addition to the fact that some aspects of legislation affecting this area are not covered in the structure of the index, there is also a problem related to the assessment of the level of the enforcement of legislation. Recent studies show that the results of empirical research focusing on the economic impact of employment protection legislation differ when using EPL measures that to larger extent take into account enforcement of regulations in comparison to the standard de jure approach of the index calculation. In this paper, we analyse the application of various indicators of institutional characteristics of the countries, which are related to the implementation of formal regulations (i.e. rule of law, level of corruption, efficiency of government, quality of bureaucracy, etc.) in order to obtain a more complete picture of the de facto values of EPL

Apstrakt: Striktnost zakonodavne zaštite zaposlenja ima značajan uticaj na tokove na tržištu rada i jedna je od važnih determinanti fleksibilnosti ovog tržišta. Empirijske stu- dije koje za cilj imaju procenu uticaja zakonodavne zaštite zaposlenja na performanse tržišta rada, pre svega na stope zaposlenosti i nezaposlenosti, ne daju konzistentne re- zultate. Različite ocene ovog uticaja za pojedine zemlje delom su posledica razlika u ostalim institucionalnim karakteristikama posmatranih zemalja, koje su često izostavlje- ne iz analize, ali u određenom broju slučajeva i teško merljive. S druge strane, i sam in- deks zakonodavne zaštite zaposlenja koji služi kao mera striktnosti ove regulative ima određene nedostatke. Pored činjenice da neki aspekti zakonske regulative koji utiču na ovu oblast nisu obuhvaćeni u formulaciji samog indeksa, javlja se i problem vezan za procenu nivoa primene zakonskih propisa. Studije novijeg datuma pokazuju da se rezul- tati empirijskih istraživanja usmerenih na ekonomske posledice zakonodavne zaštite za- poslenja razlikuju kada se koriste mere EPL-a koje u većoj meri uzimaju u obzir i pri- menu propisa u odnosu na standardan de jure obračun ovog indeksa. U ovom radu ana- liziramo primenu različitih indikatora institucionalnih karakteristika zemalja vezanih za implementaciju formalnih regulatornih rešenja (vladavina prava, nivo korupcije, efika- snost vlasti, kvalitet birokratije i sl.) u cilju dobijanja potpunije slike o de facto vredno- stima EPL-a.
