The issue addressed in our paper is complex and significant, but has so far not been sufficiently explored. The topic concerns both human rights in general, and human rights institutions that provide protection of human rights. It generally deals with the set of those questions that directly concern human being and his or her self-realization in society, the answers of which were supposed to be given in our thesis. A variety of methods have been applied, from the normative as well as the dogmatic ones, to the statistic, comparative methods as well as those referring case studies. Concurrently, the instruments for human rights protection are analyzed in elaborate detail. After analyzing the way human rights are established in light of their historical genesis, and most notably of the rights of good management in European relations, we focused on the analysis of their universalization and especially on the work and establishing of specialized institutions in the sphere of human rights. In this sense special emphasis is given to the institutions of ombudsman both on a national and international level, the method of their work and their place of the overall system of international protection de lege ferenda. In light of the realization of human rights and most of all rights for good management, we offered a comprehensive analysis of the Ombudsman work. The institution’s contribution to the successful application of the heritage of European integrations, which promote human rights as a basic value and sine qua non of all other kind of integrations. A significant part of the dissertation is dedicated to the issue of human rights protection in the region of the Former Yugoslavia, and most of all, to that of the Serbian Republic. Questions and issues of this kind are traditionally very much pertinent to the region of the Western Balkans, which makes the results of the investigation all the more important.

Питања која су обухваћена дисертацијом представљају комплексну и значајну, али још увек, недовољно истражену тему, што је била основна претпоставка да се приступи изради тезе оваквог садржаја. Предмет истраживања се односи како на људска права уопште, односно њихове елементе значајне за остваривање и заштиту, тако и, посебно, на институције које се баве заштитом људских права. Најопштије, реч је о корпусу питања која се директно тичу човека и његовог остварења у друштву и на која је у тези требало дати научно утемељене одговоре и објашњења. Ово је подразумевало примену сложеног методолошког поступка који је обухватио више различитих метода, од догматичког и нормативног, до упоредноправног и статистичког, те студије случаја. Истовремено, детаљно је елабориран низ инструмената који су у функцији заштите људских права. Након анализе утемељења људских права и њихове историјске генезе, пажња у дисертацији је усмерена на њихову универзализацију и посебно на конститусање и рад специјализованих институција у сфери заштите људских права. У том смислу посебно су опсервиране институције омбудсманског карактера на националном и наднационалном нивоу и начин њиховог рада, те место у општем систему институционалне заштите de lege ferenda. У светлу остваривања људских права, а посебно права на добру управу у европским релацијама у раду је детаљно анализиран рад Европског омбудсмана. Наглашен је допринос ове институције успешној примени у пракси тековина европских интеграција, које промовишу људска права као основну вредност и causa sine qua non свих даљих видова интеграција. Значајан део рада посвећен је заштити људских права на подручју бивше Југославије и посебно Републике Србије. Питања и проблеми ове категорије су посебно актуелни у овом региону Западног Балкана, па је утолико већи значај истраживања која су учињена у дисертацији.
