This doctoral dissertation examines the interaction between the Court of Justice of theEuropean Union (hereinafter: CJEU) and the Common Foreign and Security Policy (hereinafter:CFSP), an area traditionally characterized by limited judicial oversight. Despite these formallimitations, the CJEU has, through its case law, expanded its influence over the CFSP, particularlyin cases involving restrictive measures, the assessment of international agreements, anddetermining jurisdiction between the former pillars of the EU. The dissertation sheds light on howthe Court, through a broader interpretation of its powers, rooted in fundamental values such as theprinciples of equality and the rule of law, tests the boundaries established by the founding Treatiesand solidifies its role within the CFSP.Although initially conceived as a sphere of intergovernmental cooperation, the CFSP hasevolved largely due to the activism of the Court, which has set new rules and principles for itsfunctioning. The Lisbon Treaty further expanded the Court's powers and integrated the CFSP intothe broader framework of the EU legal system. This dissertation analyzes how these changesenabled the CJEU to play a key role in the expansion and institutionalization of the CFSP, whilebalancing judicial protection of human rights with political objectives.One of the key aspects of the research is the evolution of restrictive measures within theCFSP, which have transitioned from economic sanctions against states to targeted sanctionsagainst individuals and entities. The dissertation examines how these measures, initially designedto be preventive, have increasingly become punitive, and how the CJEU has focused more onprotecting human rights through the proportionality of these sanctions. Special attention is givento the Court’s negative stance towards the EU's accession to the European Convention on HumanRights (hereinafter: ECHR), which further illustrates the complexity of the relationship betweenthe EU legal system and international bodies.The dissertation also analyzes the relationship between the CJEU and national andinternational courts, emphasizing the Court's fight for the autonomy of EU law. Although theCJEU formally lacks the authority to assess the legality of Member States' actions within the CFSP,in practice it often assumes this role through a broad interpretation of its jurisdiction. The Courtadopts a monistic approach toward national courts, while taking a dualistic stance in relation tointernational actors, thus ensuring the coherence and unity of the EU legal order.
Ova doktorska disertacija istražuje interakciju između Suda pravde Evropske unije (udaljem tekstu: SPEU) i Zajedničke spoljne i bezbednosne politike (u daljem tekstu: ZSBP), oblastikoja je tradicionalno bila karakterisana ograničenim sudskim nadzorom. Iako formalno ograničen,SPEU je kroz sudsku praksu proširio svoj uticaj na ZSBP, naročito u slučajevima restriktivnihmera, ocene međunarodnih ugovora i određivanja nadležnosti između nekadašnjih stubova EU.Disertacija osvetljava kako Sud uspeva da kroz širu interpretaciju svojih ovlašćenja, zasnovanu naosnovnim vrednostima poput principa jednakosti i vladavine prava, testira granice postavljeneosnivačkim ugovorima i učvrsti svoju ulogu unutar ZSBP.ZSBP je, iako prvobitno zamišljena kao sfera međudržavne saradnje, evoluiralazahvaljujući aktivizmu Suda, koji je postavio nova pravila i principe za njeno funkcionisanje.Lisabonski ugovor je dodatno proširio sudska ovlašćenja i integrisao ZSBP u širi okvir pravnogsistema EU. Disertacija analizira kako su ove promene omogućile SPEU da igra ključnu ulogu uproširenju i institucionalizaciji ZSBP, istovremeno balansirajući između sudske zaštite ljudskihprava i političkih ciljeva.Jedan od ključnih aspekata istraživanja je evolucija restriktivnih mera unutar ZSBP, kojesu prešle od ekonomskih sankcija protiv država do ciljano usmerenih sankcija protiv pojedinaca ientiteta. U radu se analizira kako su ove mere, iako prvobitno preventivne, postale kaznene, aSPEU je sve više usmeren na zaštitu ljudskih prava kroz proporcionalnost ovih sankcija. Posebnapažnja posvećena je negativnom stavu Suda prema pristupanju EU Evropskoj konvenciji zaljudska prava, što dodatno ilustruje kompleksnost odnosa između pravnog sistema EU imeđunarodnih tela.Disertacija dalje analizira odnos SPEU prema nacionalnim i međunarodnim sudovima,naglašavajući sudsku borbu za autonomiju prava EU. Iako SPEU formalno nema ovlašćenja daocenjuje zakonitost postupaka država članica u okviru ZSBP, u praksi često preuzima ovu ulogukroz široku interpretaciju svojih nadležnosti. Sud primenjuje monistički pristup premanacionalnim sudovima, dok u odnosu na međunarodne aktere zauzima dualistički stav, čime seosigurava jedinstvenost pravnog poretka EU.Zaključno, disertacija ukazuje na potrebu za doslednijim metodološkim pristupom Suda uZSBP kako bi se obezbedila pravna sigurnost i usklađena sudska praksa.
