Правно расуђивање и судски активизам: случај Уставног суда Босне и Херцеговине

Constitutional democracies are based on the principle of separation of powers, which could be reduced to the limitation of government. Constitutional courts are bodies that have the task of removing an unconstitutional act from the legal order, but their activity today is much more than that. The author tries to elucidate the reasoning of the constitutional courts, stating that it is a mixture of legal and political reasoning. As a result of such reasoning, constitutional courts often reform existing law, referring to broadly formulated constitutional provisions, and this activity is usually called judicial activism.The goal of the first part of the dissertation is to explain how constitutional courts reason -legally or politically, while the goals of the second part are to provide a stipulative definition of the concept of “judicial activism” and classify forms of constitutional courts's activism. Then, in the third part, the reasoning and judicial activism of the Constitutional Court of Bosnia and Herzegovina are discussed, with the aim of evaluating its actions. Towards these goals, several methods were used, the most important of which is the method of conceptual analysis. Apart from that, comparative, dogmatic, and historical methods were also used in the research. The dissertation is not normatively oriented because it does not contain value judgments on the way of constitutional court reasoning, activism, and court decisions but is focused on the description of the reasoning of constitutional courts and examining whether it fits into the constitutional framework.The results of the research showed that: (1) constitutional courts reason legally and politically, and this violates the postulates of constitutional democracy; (2) judicial activism is neither the pure creation of law nor the mere application of existing law, but both, because constitutional courts start from constitutional principles, justify their decisions using extralegal arguments, and reform positive law in order to achieve a legitimate goal; and (3) the Constitutional Court of Bosnia and Herzegovina is rather the master of the Constitution than its guardian because it has an important influence on the constitutional arrangements of Bosnia and Herzegovina.
Уставне демократије почивају на начелу поделе власти које може да се сведе на ограничавање државне власти. Уставни судови су органи који имају задатак да уклоне неуставан акт из правног поретка, али њихово одлучивање данас је знатно више од тога. Аутор настоји да расветли расуђивање уставних судова, полазећи од тога да је оно мешавина правног и политичког расуђивања. Услед таквог расуђивања, уставни судови каткад реформишу односно иновирају важеће право. Притом се замагљује разлика између примењивања права и стварања права, а све под изговором тумачења широко формулисаних уставних одредаба и такво одлучивање се обично назива судски активизам.Циљ првог дела рада је да објасни како расуђују уставни судови – правно или политички, док су циљеви другог стипулативно дефинисање појма „судски активизам“ и класификовање појавних облика уставносудског активизма. Затим се у трећем делу разматрају расуђивање и судски активизам Уставног суда Босне и Херцеговине, с циљем да се оцени начин његовог одлучивања. Идући ка тим циљевима, коришћено је неколико метода, од којих је најважнији метод концептуалне анализе. Сем тога, у истраживању су коришћени и упоредноправни, позитивноправни и историјски метод. Рад није нормативно оријентисан јер се није тежило ка заузимању вредносних судова о начину уставносудског расуђивања, активизму и појединим судским одлукама, него се смерало ка дескрипцији начина расуђивања контролора уставности и објашњавању да ли се он уклапа у уставне оквире.Резултати истраживања су показали да: (1) уставни судови расуђују правно-политички и да то нарушава постулате уставне демократије, (2) судски активизам није ни чисто правно ни чисто политичко расуђивање, него је и једно и друго јер уставни судoви полазе од широко формулисаних уставних одредаба, oправдавају одлуке и ванправним разлозима, те мењају важеће право у настојању да остваре легитимне циљеве, (3) Уставни суд Босне и Херцеговине пре је господар Устава него чувар јер су неке од његових одлука имале одлучујући утицај на уставно уређење Босне и Херцеговине.
