The Ijtihad and forming of one's own judgement, as mentioned by Mu'adh, is further explained in the advice 'Umar gave to Abu Musa when he appointed him ajudge: "Judgement is to be passed on the basis of express Qur'anic imperatives or established Sunnah practices.."
